Rights Behind Bars is amicus counsel on behalf of disability rights groups supporting plaintiff who, in midst of a mental health crisis, was body-slammed by a police officer because the officer found him annoying. The district court decided the case on the grounds that Title II of the ADA does not allow for vicarious liability, meaning that a plaintiff would have to prove that a municipality, and not simply one of a municipality’s employees, discriminated against him to win a case under the ADA. If affirmed, Ingram would create circuit split. Though this is a policing case, not a prison case, it involve issues that are very significant for prison litigation as well.
